Defendant, Joseph sweeney did execute a Patient Information Form with Plaintiff, whereby, he agreed to be responsible for any charges regardless of any insurance coverage. As evidence whereof, a copy of the Patient Information Form is attached hereto, made a part hereof and marked Exhibit "B". 6. Any and all monies received have been credited to the Defendants' account leaving a balance due and owing of $4,935.00. (See Exhibit "A" attached hereto) 7. Plaintiff has made demands upon Defendants for payment of the aforesaid balance due and owing, which demands remain unheeded. COUNT I. (Plaintiff v. Joseph Sweeney) (Breach of contract) 8. Plaintiff incorporates herein by reference thereto the averments hereinabove set forth in paragraphs 1 through 7. 9. Pursuant to the Patient Information Form, Defendant agreed to assume responsibility for any charges regardless of any insurance coverage, which charges amount to $4,935.00, 10. Plaintiff has made demands upon Defendant for payment of the balance due of $4,935.00, which demands remain unheeded. WHEREFORE, Plaintiff prays you Honorable Court to Enter Judgv.ent in its favor and against Defendant in the amount of $4,935.00 along with interest at the rate at 6% per annum and the costs of this proceeding. COUNT II. (Plaintiff v. Joseph Sweeney) (Quantum meruit) 11. Plaintiff incorporates herein by reference thereto the averments hereinabove set forth in paragraphs 1 through 10. 12. Plaintiff did render orthopaedic services to Defendant with the r~asonable expectation that payment for such services would be made by the party benefitted, 13. Should Defendant not be required to pay for the balance due for the services rendered, Defendant would be unjustly enriched at Plaintiff's expense. WHEREFORE, Plaintiff prays your Honorable Court to enter Judgment in its favor and against Defendant Joseph Sweeney in the amount of $~,9)5,OO along with interest at the rate of 6% per annum and the costs of this proceeding. COUNT I II . ( Plaintiff v, Debra Sweeney ) (Doctrine of neceesaries) 14. Plaintiff incorporates herein by reference thereto the averments hereinabove set forth in paragraphs 1 through 13. 15. Plaintiff believes and therefore avers that the orthopaedic services rendered, upon request, to Defendant Joseph Sweeney, husband of Defendant Debra Sweeney, were necessary for his benefit and welfare. 16. Plaintiff believes and therefore avers that pursuant to the "doctrine of necessaries", Defendant Debra Sweeney, as spouse of the recipient of health care services, is liable to Plaintiff for the balance due. 17. Should Defendant Debra Sweeney not be held liable to Plaintiff for payment of services rendered her husband, she would be unjustly enriched as the services were necessary to benefit the health and welfare of her husband and their marital union. 18. Plaintiff has made demands for payment upon Defendant, which demands remain unheeded. WHEREFORE, Plaintiff prays your Honorable Court to enter Judgment in its favor and against Defendant Debra Sweeney in the amount of $4,935.00 along with interest at the rate of 6% per annum and the costs of this proceeding. , . COUNT IV, ( Plaintiff v. Debra Sweeney) (statute) 19. Plaintitf incorporates here'in by reference thereto the averments hereinabove set forth in paragraphs 1 through 18. 20. Pursuant to 23 Pa,C,S.A. 4321, married persons are liable for the support of each other. 21. Pursuant to 23 Pa.C.S.A. 4102, where debts are contracted for necessaries by either spouse, a creditor may institute suit against the husband and wife for the price of the necessaries. 22. Plaintiff did render necessary health care services to Defendant Joseph Sweeney with the reasonable expectation that such services would be paid for by the persons benefitted, which in the instant case include said Defendant and his wife, Defendant Debra Sweeney as partner in the marital union. 23. The plaintill' avers that Mr, Sweeney is liable for the balance under the Doctrine of Necessities, 3. The common law Doctrine of Necessities, however, is repugnant to the Equal Rights Amendment, Article I, *28 of the Pennsylvania Constitution. 4, Common law causes of action which are in conflict with the Pennsylvania Constitution arc null and void and therefore, Count III ofplaintitrs complaint fails to state a cause ofaction upon which relief may be granted, WHEREFORE, the defendants request that the Court grant their preliminary objection to CounlllJ ofplaintitrs complaint lor the plaintill's failure to state a cause of action against Mrs. Sweeney upon which relief may be granted, OBJECTION TO COUNT IV OF PLAINTIFF'S COMPLAINT: LEGAL INSUFFICIENCY OF PLEADING - DEMURRER 5, The defendants hereinafter incorporate by reference the averments set forth in paragraphs one through lour, 6, The plaint ill: in his complaint, did not a1ledge any factual or contractual basis which would support the plaintilfs claim that Mrs, Sweeney was liable to the plaintiff for the balance due on his medical bills to the plaintiff. 7, Thc plaintil1'in his complaint has not alleged that Mrs. Sweeney requested that thc plaintill'treat her husband. nor did the plaintilhlleged or provide support that thc plaintiff contracted lor such treatment. Kusic, Esquire and respectfully makes its Answer to Defendants' preliminary Objections as follows: Answer to Obiection to Count III of Plaintiff's Comolaint Demurrer 1. Denied. By way of further answer, whatever Defendants believe lies within the control of Defendants, adverse and hostile parties, and strict proof thereof is therefore demanded. Furthermore, Plaintiff believes and therefore avers that Count III of its Complaint does in fact state a claim upon which relief may be granted. 2. Denied as stated since Plaintiff believes and therefore avers that Defendants' allegation contains a typographical error which confuses the meaning of the allegation. Plaintiff avers that Defendant Debra Sweeny as spouse of Joseph Sweeny is liable to Plaintiff under the Doctrine of Necessaries for services provided him by Plaintiff. 3. Defendants set forth a conclusion to which no answer is required. However, should an answer be required, then Plaintiff denies Defendants' allegation and avers to the contrary that such doctrine is not repugnant to the Equal Rights Amendment and further that the Doctrine has been codified under 23 Pa.C.S.A. 4102. 4. Defendants state a conclusion of law to which no answer is required. However, should an answer be required, then Plaintiff denies Defendants' allegation and avers to the contrary that: (a) the Doctrine of Necessaries is not in cor.flict with the Pennsylvania Constitution; (b) the common law cause of action is not null and void; and (c) Plaintiff's Complaint sets forth a cause of action upon which relief may be granted. WHEREFORE, Plaintiff prays your Honorable Court to dismiss Defendants' Preliminary Objections to Count III of Plaintiff's Complaint and allow this matter to procp.ed. Admitted in part and denied in part. Plaintiff admits that it did not aver that Defendant Debra Sweeney requested Plaintiff to treat her husband. However, Plaintiff denies the remainder of Defendants' allegation and avers, to the contrary, that: (a) spouses are liable for the support of each other; and (b) Defendant Debra Sweeney is liable to Plaintiff for the services rendered her husband. 8. Admitted in part and denied in part. Plaintiff admits that it did not state in its Complaint that Defendant Joseph sweeny was dependent upon his wife or indigent. However, Plaintiff denies the remainder of Defendants' allegation which sets forth a conclusion to law. 9.
