AND NOW, comes the PlaintilT, Craig C. Redmond. by his allorney. Velma A.
Redmond, Esquire, and makes this Complaint against Defendant Sun Mitsubishi, as follows:
I. Plainliff Craig C. Redmond is an adult individual who resides at 410 Mcl.and
Road. Mount Holly Springs, Cumherland County. Pennsylvania.
2. Defendanl Sun Mitsubishi is a PennsylvaniiA corporation which regularly con-
ducts business within the Commonwealth of Pennsylvania and within Cumbcrland County.
Pennsylvania, and has its principal place of business at 4434 Carlisle Pike. Cilmp Hill,
Cumberland County. Pennsylvania.
J. At all limes pcrtincnt hcrcto. Craig C. Redmond was the owner of a 1994
Mitsubishi Montero, vchicle identification numbcr J94MR5IMORJ0090(JO (hercinafter the
"vehicle").
4. Al all times pcrtinent hcreto, Sun Mitsubishi was an Aulhorized Mitsubishi
Motors Dealer and was acting within its scope as an Authorized Milsubishi Motors Dealer.
5. Craig C. Redmond purchased the aforcmenlioncd vehicle on or aboul May 3,
1994 from Lancaster Mitsubishi located in East Petersburg, Pennsylvania.
6. The aforesaid vehicle is covcred by a Milsubishi Motor Sales of Amcrica. Inc.
new vl'hicle warranly, a copy of which is allachcd and marked as "Exhibit A".
7. The new vehicle warranly on I,he aforesllid vehiclc provides that for the first
three years or 36.000 miles (58.000 km), whichevcr occurs first. any parI of the vehicle
which provcs defectivc in normal usc will bc rcpaired or replaced by any Aulhorizcd
Milsubishi Molors Dcalcr.
8. III order to oblain warranty or adjustmcnl service undcr thc terms of the vehi-
c1e's new vehicle warranty, the owner i~ required to return thc vehicle to any AUlhoriled
Mi15ubishi Motors Oealer's or Allthoriled Servicc ('enter's place of hu~ine~s. whcre ~uch
services are to be performed without charge for part5 or labor.
9. On September ZO. 1995 and November 15, 1995 Crai g C. Redmond pre5ented
the vehicle to Sun Mitsubishi at its place of bU5ines~ un,ler the new vehicle warranty for
repair of the following defective part~. all of which are covered by the new vehicle warran,
ty:
Catalytic Converter
front passenger window regulator
front anti,sway bar
front window seal
front d.uhboard
10. Sun Mitsubishi refused or failed to make the necessary rt~airs to the afore-
mentioned defective parts of the vehicle in accordance with the new vehicle warranty.
II. At all times relevant he,'eto the vehicle mileage was less than .16,000 miles
and within the three-year term of coverage.
12. On September 29. 1995, Craig C. Redmond purchased an extended service
contract from Sun Mitsubishi. The extended warranty, known as "Triple Diamond
Protection Portfolio", was purchased from Sun Mitsubishi at a total cost of One Thousand
Three Hundred Eighty-Three Dollars and Thirty Cents ($138.1.30). which is evidenced by
the Application allached and marked as "f.lthibit B".
13. The Effective Date of the elttended warranty is January 2, 1994, and covers
the vehicle for silt years from January 2. 1994 or 100.000 miles, whichever occurs first.
14. The elttended service contract sold to Craig C. Redmond by Sun Mitsubishi
provides that Mitsubishi Motors of America, Inc. will reimburse the owner of the vehicle.
or any authoriled repair facility, the repair cost to remedy a mcchanical breakdown of any
component of the vehicle list as a covcred assembly component, less deductible, provided
the mcchanical breakdown must occur during the tcrm of the contract.
15. On Novcmbcr 15. 1995, Craig C. Redmond prcscntcd the vehiclc to Sun
Mitsubishi at its place of busines~ for rcpair of defectivc parts covered under the elttellded
servicc contract.
