Defendant's brief and oral argument held April 15, 1998, Plaintiff's exceptions to
the order of equitable distribution filed July 17, 1998,are dismissed.
Plaintiff filed three exceptions to the order of equitable distribution. The
exceptions are: (1) the Judge's failure to award alimony pendente lite from
November of 1993 until a divorce decree is entered; (2) failure of the Judge to
award alimony; and (3) failure to award court costs and counsel fees. Under the
Pennsylvania Rules of Civil Procedure, no motions for post trial relief may be filed
to any order of the trial judge concerning claims involving marital property, alimony,
alimony pendente lite, or counsel fees, costs and expenses. Pa. R. Civ. P.
1920.52 (a) and (b). Pursuant to Pa. R. Civ. P. 1920.52, Plaintiff's exceptions are
improper and hereby dismissed.
In addition, Plaintiff failed to file a brief in support of the exceptions and did
not appear before this court to argue in favor of her position. Pursuant to Rule of
the Cumberland County Court of Common Pleas 210-7, any issue raised but not
briefed is deemed abandoned. Therefore, Plaintiff's failure to comply with the
Local Rules further justifies the dismissal of her exceptions.
