HOLLOWAY NO. 485 SUPPORT 2005 MEMORANDUM OPINION AND ORDER OF COURT BEFORE GUIDO. J. The defendant has filed exceptions to the November 14,2006, interim order of court entered pursuant to the Support Master's Report and Recommendations of the same date. He alleges that the Support Master erred in calculating his monthly earnings. Specifically he contends that since his overtime is not guaranteed, it should not have been included as part of his monthly income. However, the record clearly establishes that the defendant was averaging 5 hours per week overtime in his employment in the months leading up to the Master's Hearing. Therefore, his exceptions must be dismissed. 1 ORDER OF COURT AND NOW, this day of MARCH, 2007, Defendant's exceptions to the Support Master's Report and Recommendations are DISMISSED and the Interim order of November 14, 2007, is hereby made FINAL. By the Court, Edward E. Guido, 1. Danika L. Estill Warren C. Holloway DRO 1 In his brief the defendant asserts that he is no longer receiving overtime. While this may be grounds for him to file a petition to modify his current support order, it does not provide a basis to challenge the previous order which was entered on the basis of the evidence presented at that time.
