Upon consideration of the cases cited in her memorandum, we are satisfied that this is an evidentiary matter which would be more properly raised at the time of trial. Our prior Order of January 19, 2000, is vacated inSofar as it directs the parties to file briefs by certain specified dates. Instead, the parties are directed to file briefs in support of their respective positions before the commencement of trial.
