IN RE' DEFENDANT'S SUPPORT APPEAL
BEFORE GUIDO,
OP~ON AND ORDER OF COURT
Plaintiff filed a complaint for child support on September 28, 1999. A conference
was held before the Domestic Relations Office and we entered a recommended order on
November 16, 1999, effective September 28, 1999. Defendant filed a timely request for a
heating de novo which was held before this court on February 24, 2000.
FINDINGS OF FACT
1) Plaintiff is employed as a construction worker for a temporary agency and earns a
gross weekly salary of $250. His net monthly income is $962.~
2) Defendant is employed by the Commonwealth of Pennsylvania. Until December 31,
1999, her net monthly income was $1467. Commencing January 1, 2000, her net
monthly income increased to $1494.
3) The parties are the natural parents of Marina Starr Morris, D.O.B. February 7, 1984,
and Amber Rose Morris, D.O.B. February 19, 1986.
~ This is based upon a filing stares of single head of household with exemptions for himself and three
children.
928 SUPPORT 1990 - PACSES # 294101545
4) Marina lives primarily with plaintiff and visits occasionally with defendant.
5) Amber lives primarily with defendant. However, she spends approximately forty-
five (45%) of her overnights with plaintiff.
6) The defendant's employer provides medical benefits to the children at no cost to
defendant.
7) Neither party has any expenses which would justify a deviation from the support
guidelines.
DISCUSSION
Applying the support guidelines to the facts of this case, we have determined that
defendant's net monthly support obligation to plaintiff from September 28, 1999, through
December 31, 1999, was $204.2 Defendant's net monthly support obligation to plaintiff
increased to $213 commencing January 1, 2000.3 In addition, since the defendant has
medical insurance provided by her employer without cost to her, we will require her to
maintain medical insurance on the children. Therefore, we will enter the order that
follows.
