MEMORANDUM OPINION AND ORDER OF COURT
After hearing, we make the following findings of
fact, conclusions of law, and order-
FINDINGS OF FACT
1. The parties are the parents of three
children, David, age 16; Andrew, age 14; and Joshua, age
10.
2. The Plaintiff filed a complaint for child
support and spousal support on May 4, 2000.
3. The Defendant left the marital residence as a
result of a protection from abuse order entered against
him.
4. Plaintiff has a net monthly income of
$1,300.00.
5. Plaintiff pays $84.70 bi-weekly for health
insurance which covers the entire family including
Defendant.
6. Defendant has a net monthly income of
$1,454.00.
7. Neither party has any extraordinary expenses
that would justify a deviation from the support guidelines.
CONCLUSIONS OF LAW
1. Defendant is liable for spousal support and
the support of his three children. The order is effective
May 4, 2000.
2. Based upon the guidelines, because of the
parties' limited income, an award for spousal support is
not appropriate.
3. The Defendant's total monthly child support
obligation is $675.06. The support guidelines calculations
are attached hereto as Exhibit A.
ORDER OF COURT
AND NOW, this 12th day of October, 2000, the
Defendant is ordered to pay the sum of $675.06 for the
support of his minor children, David Benton Eckert, Andrew
Lee Eckert, and Joshua Ray Eckert. This order is effective
May 4, 2000. In all other respects, our order of July 13,
2000, shall remain in full force and effect. Plaintiff
shall maintain medical insurance on the parties' children.
The parties shall share unreimbursed medical expenses on an
equal basis.
