In this personal injuryaction, Plaintiff, Ronald Wheeler alleges that the Defendants
negligently maintained cooling towerscausing the towers to expel high levels of Legionella and
his alleged exposure to Legionella resulted in illness and mental anguish. However, for the
purposes of this appeal, Plaintiff has challenged this courtorder issued on February 8, 2022
denying Plaintiff022,
Plaintiff filed his Notice of Appeal to the Commonwealth Court. On February 25, 2022, this
court issued an order directing the Plaintiff to file his concise statement of errors complained of
on appeal within twenty-one days of theorder and indicated any issue not raised would be
waived. On March 9, 2022, Plaintiff timely filed his Statement of Matters Complained of on
Appeal. Plaintiff raised eight separate arguments, none of which had anything to do with this
courthissecond Petition for Leave to Appeal Nunc Pro Tunc.
Therefore, Plaintiff has waived any validarguments for this appeal.
