The Defendant has filed this timely appeal from our Order of Sentence dated
October 27, 2009. This only issue raised on appeal is that the Suppression Court
Judge erred as a matter of law in determining that the probable cause affidavit in
support of a search warrant for Defendant’s residence contained within its four corners
was legally sufficient grounds for issuance of the search warrant and that the evidence
obtained as a result of the search warrant was admissible in evidence. This matter was
decided by the Honorable J. Wesley Oler, Jr., by Order of Court dated February 20,
2009, which is attached hereto. The reasons for Judge Oler’s decision are set forth in
his opinion dated December 22, 2009.
