D. tSy7. d s~ csso~•. ., ' Y.?at~ . ~~ p-'y. s AN ACT ~ To provide for the attendance of children in the Schools of this Commonwealth, and making an enumeration of children for that purpose ; also providing compensation for the assessors making the enumeration, and providing penalties for violation of this act. SECTIO?t t. Be it enacted, &c., That every parent, guardian or other person in this Commonwealth, having control or charge of a child or children between the ages of eight and sixteen years, shall ix required to send such child or children to a day school in which the common $nglish branches are taught, and such child or, chil- dren shall attend such school continuously during at least seventy per centum of the tithe in which schools in their respective dis- tricisshall be in session, which period of compulsory attendance shall begin at the beginning of the school term, or at a time fixed by the board of directors or controllers when they meet to organize, unless such child or children shall be excused front such attcud- ance by the hoard of the school district in which the parent, guar- dian or other person resides, upon the presentation to said board of satisfactory evidence showing such child or children are pre- reated from attendance upon school or application to study b} mental, phcsical or other urgent reasons: Provided, That this act shall not apply to arty child between the ages of thirteen and six- teen czars that is regularlti- engaged iv any useful employment or service: Provided, 'c'hat in case there be no public school iu ses- ~i.~u within two wiles of the nearest traveled road of anv person Rithin the school district, he or she shall not he liable to t}u pro- visions of this act: Yrocided, That this act shall not apply to anv child that has been or is being otherwise instructed in F,uglish in the common branches of learning for a like period of time : And provided further, '1'}tat an }• principal of an}- private school or ed- ucatirntal institution, or ern' teacher giving private instruction, shall report, as provided iu rection five (5) of this act, and shall fur- aah monthly to each child under his care, or to its parents or Ica-dian, a certificate duly signed that such child has been or is t,e:nst instructed, as proc-ided by this act, which certificate shall be se=eitnt and satisfactory evidence thereof. ~aeTtoa z- Fur every neglect of duty imposed by the first section of This act, the principal teacher or person in parental rdatuoo offending shall be guilt}- of a misdemeanor, and shall upon r~nriction thereof before a justice of the peace or alderman, forfeit a ntx not ezceaiiug tKO dollars on the first eonciction, and a fine not exceeding five dollars for each subsequent conviction : Pro- rided, Cpon conviction the defendant or defendants mac appeal to tbt eoart of quarter sessi~,ns of the peace of the proper county rithia tbirtr dots, upon entering into recogniunce an+h otae wrtli, fir the amoaat of fines sad costs : Prodded 6a,taeset. 7fae leiee asri iKa+ity shall be inczrred tie poreat. Before such penalty shall be incurred by such child, the parent, guardian or other person in parental relation to the child shall be uo- tified in writing by the secretary of the school board, or Ly the at- tendance officer if there be one, and shall have au opportunity to be heard; such person in parental relation may elect to have such child cared for and maintained at his own expense in a private school, orphans' home orsimilar institution where the couutton English branches are taught. If snc}t person in parental relation to such child shAll not elect to care for and maintain such child in such pric•ate school, nor consent to his care, maintenance and instruc- tion in the public special school, then such conduct of the child shall be deemed disorderl}• conduct, and the child tna}' be pro- ceeded against as a disorderly person; and upon conviction thereof sliall be sentenced to such special school for a term not exceeding the remainder of the school term iu his district, sul,ject to parole for good conduct by the authorities of such special school after four weeks attendance. Such special schools shall be conducted with a view to the improvement and to the restoration, as soon as practicable, of such child to the school or institution elsewhere which he may be lawfully required to attend. The board of di- rectors or controllers of any city or school district not hoeing such special school, Wray contract with anv other city or district having such school for the care, maintenance and instruction therein of children ~ehom such boards of directors or controllers aright re- quire to attend such school if there were one in their oten city or district. - S$CTION q.
