It is also mutually agreed that it the we:~iher is not such as to admit of the proper painting of the work, the non-painting is nut to hinder
srttlemeni, but a reasonable sum may he retained lu ensure its perfurm:ulce at a suitable time, otherwise the balance due is to be paid in full;

work at the bridge site.
And for the performance of each and every article of this agreement the said parties hereby hind themselves by these presents.
