D. 1922, by and between the Corr~on- wrealth of Pennsylvania, hereinafter called the Commornvealth, by tb State ?iighway Cornnissioner, of the first part, and the County of Cum- Berland, by its County ComrnissionQrs, of the second part, and the ;ounty of York, by its County Commissioners, of the third part. t'J~R~:.~S, the point County bridge located on State Aighwa 3oute Ho. 123, at Station 495f55.4, in Upper Allen Totynship, Cumber- land County, and Carroll Tovrnship, York County, is in need of recon- struetion in order to safegia.ard the travelin{~ ;~~ublic, and HEREAS, The said Counti.as of York anal Cumberland have been ~tharized by the Grand Juries of tho respective Counties underAat of Assembly in such case made and provided to oonstra.et a nevi bridge on the site of the pr®sent inter-county bridge, an H~i~AS, The Counties of York and Cumberland such reconstructed bridge shall conform to the standards and b® con- struot®d under the supervision of the State Highway Department, type of construction to be a reinforced concrete "T" bsartt bridge, aon- silting of thr®e spans, 42 feet each in the clear, bridge to we skewed 45 degrees and have a width of 24 feet between parapets, ~a ith an av- erage clearance of 10 feet, at an estimated cost of X18,797.49, based upon the quantit ies and unit _~?riaes shown on the pr®lirninary estimate ~repaxed by and on file vaith the State Highw€-y Department. iSOt'~ , THU' iiy~ O i~. 'T'hat the State Highway Commissioner shall make al] necessary surve~%~, ~~xepare all neeessaxy plena, and shall advertise for bids and shall ad~a,rd for the Counties of Cumberland and York con- tract or aontracte for the construction of the said bridge, in a sure not to ®gaeed the amount of the aforern~;ntioned preliminary estimate and • Second. That th® Counties of Cumberlana ana ~vl-x, ~.l- ter award by the state Highway Departm®nt, mhall enter into a oon- tract with the su.coeasful contractor for the aonstxv.ction of said bridge and shall defray the total cost and exper~ss of said improve- ment, exeludin~; all survey, engineering, advertising and inspection expenses. `Phird.. 'ihat the Counties of Cumberla,rs.d aiZd 'for~~_ shall Y}a.y to the contractor, once each month or from time to time as the work progresses, the amount due for wor'•c performed in accordance t~~,ith the current estimates furnished the said Counties by the Stat® Highway Department. :~~rom the total of the amounts so ascertained will be deduct®d arl amount eq~aivalent to ten (l0) per oentum of the whole, to be retained by the Counties of Cumberland and York until after the pompletion of tho entire contract in a manner acceptable to the State gighway Department. In cases wher© the ninety {90) per aentum of the amount earned during one month or period shall be less than one thoue~ and dollars (1,000) no payment will be made until the ninety {90) per centum of the total gmount earned since the last preceding pay- ment ie at least one thousand dollars (~K 1, 000) . Fourth. That work may be done and m~a.terial furnisY~d under the aforementioned contract in excess of the contract prise to the extent of ten { 10) per eentu.~~, upon ~r~-ritteri ordor of the Chief Er~in- eer of the State ~Tighway Department, but if additional ~ror~L and ma- terial be;;~ond ten (10) per centum of th6 contract shall be recuired, su.eh work or material shall not be ordered by said Chief Engineer, without the ~rritten consent of tho Commissioners of Cumberland and York Counties.
