In this criminal case, Defendant has appealed to the Superior
Court from a judgment of sentence imposed by the writer of this
opinion. He was found guilty following a jury trial of robbery,
conspiracy to commit robbery and attempted robbery. The victim was
a cab driver and the offenses occurred in 1988.~
The sentencing order was as follows:
AND NOW, this 18th day of March, 1997,
the Defendant, David Duane Delnicki, now
appearing in court with his privately retained
counsel, Allen C. Welch, Esquire, for
sentencing, and having previously been found
guilty following a jury trial of Robbery, a
felony of the second degree, Conspiracy To
Commit Robbery, a felony of the second degree,
and Criminal Attempt To Commit Robbery, a
felony of the second degree, and the Court
being in receipt of a pre-sentence
investigation report, upon which it relies,
the sentence of the Court is as follows:
At Count A, Robbery, the Defendant is
sentenced to pay the costs of prosecution, and
undergo imprisonment in a State Correctional
Institution for a period of not less than 10
months nor more than 36 months, with credit to
be given for 22 days previously served.
At Count B, Conspiracy To Commit Robbery,
a felony of the second degree, the Defendant
is sentenced to pay the costs of prosecution,
and undergo imprisonment in a State
