The defendant has filed a timely appeal to our order of October 25, 2005,
directing defendants’ expert witness to provide certain financial information. All parties
agreed that the information was discoverable pursuant to the Superior Court’s decision in

J.S. v. Whetzel, appeal of Perry Eagle, M.D., 860 A.2d 1112 (Pa.Super. 2004).
Defendants’ counsel pointed out that the Pennsylvania Supreme Court has granted
allocatur in another case involving similar issues. Nevertheless, until the Supreme Court
rules on the matter, we are bound by the Superior Court’s decision in the Wetzel case.
