TIME OF SHIFMENT
Fall shipments are usually made during Oct. and Nov. and Spring
shipments March, Aprih May, according to locelity and weather but
shipment at any specified date ins not guaranteed.
The agreement to supply the stock for this order is subject to a
Nursery crop lailure, lack of transportation or any contingency not
written in this contract.
TRIIE TO NAME WARRANTY
Anp stock that proves untrue to name as labeled is io be replaced
free of extra charge or purchase price refunded, and the seller's total
liability for any breach under this contract is limited to such purchase
price or such replacement. It is understood and agreed moreover that
no warranty, expressed or implied, as to the descnptions, quality, pro-
ductiveness, life or otherwise is given, and the seller shall not rn any
way be held responsible for the crops raised from the stock hereby
purchase that then ordered.

COLLECTION COSTS
Purchaser agrees to pay for stock shipped at time specified in this
order and upon failure to do so, to pay all collection expenses includ-
ing court costs and a reasonable attorney's tee should the accouuf be
placed fox collection with ar. attorney or collection agency. Purchaser
also agrees as follows: In the event of delauit in payment I authoriao
any attorney to cppecr for me and confess j>adgment against are for
the amount in default, except that the pzovrsions of this paragreph
shall not apply and shall not be a part of the contract in States where
such provisions are prohibited by law.
If notified within 5 days after arrival, seller agrees to ship to pur-
chaser promptly nay items short or damaged is original shipment
without any additional charge.
CONDITIONS UNDER 'T/Y.iCH SHIPMENT OF ORDER MAY
BE DEFERRED TO A LATER SEASON.
Should purchaser request seller to defer shipment until a later sea-
son, such request must bo accompanied by a deposit of 50 % of the
amount of the order, same to teach seller on or before September 1st,
~tor fall delivery, and February lsi. for Spring delivery. Should pur-
chaser later request that shipment be sent fall credit wilt be allowed
for deposit made.
SUBSTITUTIONS
It is our desire to avoid al] substitutions. However, crop failure,
adverse weather and other factors beyond our control sometimes ccuso
shortages at shipping time. When this occurs, it is our policy 4o select
a variety nearest in all respects to the variety ordered. Thrs is done
to avoid empty spots in the planing. If the variety we send you is not
satisfactory the variety originally ordered will ba sent the following
shipping season at the customer's request. This policy will be followed
in filling this order un]ess we are directed not to do so on the reverse
side.
