ORDER OF COURT AND NOW, this ~ day of June, 1996, after careful consideration of the preliminary objections of Defendant William A. Sullivan, M.D., to Plaintiff's complaint: a. The court believes that the complaint satisfies the requirement under Pa. R.C.P. 1019(a) for a "concise and summary statement" of the material facts that underlie the Plaintiff's claim, and accordingly Defendant's preliminary objection in the form of a motion to strike Count VII of Plaintiff's complaint is DENIED; and b. The court believes, given the allegations of the complaint, that the issue of whether a sufficient factual basis for an award of punitive damages on a theory of "reckless indifference to the rights of others" might exist in this case can be better considered upon a more developed record, and accordingly Defendant's preliminary objection in the form of a demurrer to Plaintiff's claim for punitive damages in Count VII of the complaint is DENIED.
