Elections for Aldermen or Justices of the Peace held at any other time than the third Tuesday of February are null and voi Art. V, Sec. 11, and Art. VIII, Sec. 3. It is the duty of the Constable of the proper ward, district, borough or township, to give at least TWENTY DAYS NOTI( ment, preceding the election to be held on the third Tuesday of February of each year, of the expiration of the term of the cc Alderman or Justice of the Peace that may expire on or before the first Monday of May following, and also of any vacancy tha death, resignation or otherwise. Act 22 March, 1877, P. I 12. An Alderman or Justice of the Peace elect, if he intends to accept said office, must give notice thereof in writing to the P: thirty days after his election, stating therein the name of the Alderman or Justice of the Peace he succeeds, with the cause of vacancy. The only recourse that a Justice -elect has, when he has failed to file his acceptance within the law, is application to the Governor for appointment until the first Monday of May succeeding the next election. The time within which acceptance must be flied by a Justice -elect is fixed by law, and cannot be extended by the Governor. The only recourse that a Justice -elect has, when he has failed to file his acceptance within the time required by law, is appiict for appointment until the first Monday of May succeeding the next election.
